>e paper studies the discussion about human good in Eudemian Ethics I.7. It is particularly concerned with the existence, in the text, of two characteristics of the human good: its peculiarity, on the one hand, which consists not only in the quali- (cation ‘human’ (anthropinon), but also in the assignment of this good to the domain of action (the activity that distinguishes humans from other beings), and, on the other hand, the fact that it belongs to a spectrum containing the (...) goods of other beings, like god and the remaining living beings. Divinity works as the standard for the distinction between eudaimonic goods – belonging to beings whose nature implies participation in the divine (humans, for example) – and non-eudaimonic goods that belong to those beings deprived of such participation. Resorting to other passages from the Eudemian Ethics, as well as other texts from the corpus, the paper defends that the two characteristics of the human good presented in EE I.7 foreshadow an important di?erence between the two Aristotelian treatises on eudaimonia: whereas the Nicomachean Ethics emphasizes contemplation as the activity through which humans participate in the divine, the Eudemian Ethics stresses virtuous actions as a human activity related to the divine. The aim of this paper is to study a set of three issues related to the understanding of partial justice and partial injustice as character dispositions, namely the distinctive circumstance of action, the emotion involved therein and the pleasure or pain following it. Those points are treated in a relatively obscure way by Aristotle, especially in comparison with their treatment in the expositions of other character virtues in the Nicomachean Ethics. Building on the expression ‘capacity towards the other’ (δύναμις ἐν (...) τῷ πρὸς ἕτερον), the paper highlights the interpersonal nature of the circumstances of just and unjust actions, and points how such nature is directly related to notions such as ‘profit’ (κέρδος) or ‘getting more’(πλεονεκτεῖν) as well as to the unusual conception of excess, defect and intermediacy in Nicomachean Ethics Book V. The interpersonal nature of just and unjust actions works also as the starting-point for the interpretation both of the pleasure briefly mentioned in 1130b4 as characterizing the greedy person and of the emotion involved in acting justly or greedy, which is mentioned in an extremely elliptical way in 1130b1-2: the paper argues, on the one hand, that the pleasure felt in acting justly or unjustly concerns not only the goods that are the object of just or unjust interactions, but also the way such interactions affect the people involved; on the other hand, it argues that the emotion actuated in just or unjust interactions relates to the agent’s concern or lack of concern with the good of those people. The essay discusses the interpretation of Aristotle's natural right teaching by Leo Strauss. This interpretation ought to be seen as the result of an investigation into the history of philosophy and of an attempt to philosophically address political problems. By virtue of this twofold origin, the Straussian commentary is unorthodox: it deviates from traditional Aristotelianism (Aquinas and Averroes) and it seems alien to the text of the Nicomachean Ethics. Strauss's criticism of medieval variants results from their incapacity—shared by contemporary political (...) thought—to address a perplexing issue: political exception. He sees in Aristotle's political teaching a way to escape from this failure: the unification, in natural right, of the requirements of statesmanship and ethics. The discovery of this way allowed Strauss to produce an interpretation of natural right that articulates important points pertaining to Aristotelian political science. (shrink)

Our reflections on LAWS issues are the result of the work of our research group on AI and ethics at the Informatics Center in partnership with the Information Science Department, both from the Federal University of Pernambuco, Brazil. In particular, our propositions and provocations are tied to Bianca Ximenes’s ongoing doctoral thesis, advised by Prof. Geber Ramalho, from the area of computer science, and co-advised by Prof. Diego Salcedo, from the humanities. This book brings together a number of researchers of different nationalities to reflect on religion and philosophy in ancient Greece. These scholars have been convened by the Brazilian research group Delphos and discuss, in particular, how religious and philosophical thought intertwined during this period. Among the papers collected here, several are devoted to epic and philosophical literature before Plato. The others deal, alongside this great classical philosopher, with Aristotle and Philo of Alexandria. These contributions allow us to recognise how the (...) vision of the cosmos, metaphysics and human life are intertwined in Greek thought. A journey is made from traditional Greek religion to its philosophical reinterpretations, reaching as far as the monotheistic God of Judaism made known in the Hellenic language. The nature of the cosmos, investigated scientifically, is no stranger to the Greeks' view of the divine, but neither is ethics, with all its demands. Thus, these studies provide a kaleidoscopic view of the various points of view from which nature, the human condition and divinity are approached through the eyes of ancient Greek literature. O livro Verdade e Linguagem em Nietzsche, organizado por André Luís Mota Itaparica e Márcio José Silveira Lima, reúne oito artigos apresentados por ocasião do XXXII Encontros Nietzsche, seminário promovido pelo Grupos de Estudos Nietzsche (GEN) e realizado em Salvador, em 2012. Publicada em 2014, a unidade da obra, como indica o título, passa pelo compartilhamento de uma temática comum: a relação entre linguagem e verdade no pensamento nietzschiano. Apesar de reconhecermos a estreiteza de uma tal relação, cabe (...) ressaltar que é o problema da linguagem que ocupa posição central, sendo, sem dúvidas, sua articulação com a verdade um elemento observado por diversos dos autores. Nesse sentido pode-se dizer que o leitor da obra descobre que o ponto mínimo para o qual convergem os autores é a importância da reflexão sobre a linguagem para os caminhos tomados pelo pensamento nietzschiano. Isso não significa, no entanto, que haja comunhão em torno de uma tese geral que apenas seria desdobrada por autores distintos. Pelo contrário, um dos méritos do livro reside justamente no fato de apresentar a complexidade e riqueza do pensamento nietzschiano a partir de uma certa temática. (shrink)

Este artigo visa compreender o estado da arte do naturalismo contemporâneo a partir da discussão com posições não naturalistas, em especial as de Moore e Rawls. Parte-se da análise do argumento central destas abordagens no contexto formal da metaética contemporânea, buscando aferir a validade da falácia naturalista no contexto atual, bem como de seus limites na aplicação contra o naturalismo moral. Apresenta-se a discussão entre o naturalismo e o não-naturalismo moral como, respectivamente, estandartes das perspectivas descritivas e prescritivas da moralidade. (...) O Agreste de Pernambuco é conhecido como a bacia leiteira do estado, por possuir não apenas um efetivo bovino leiteiro significativo, mas por apresentar características edafoclimáticas que tornaram possível o desenvolvimento da atividade leiteira. Entretanto, uma vez que possui um clima Semiárido, o cruzamento de raças taurinas com zebuínas é de suma importância, logo, um dos métodos de cruzamento mais abrangente e expressivo no estado é acasalar touro holandês PO com vacas Gir, obtendo F1 ½ HG, que são acasaladas com (...) touro holandês PO, obtendo-se F2 ¾ H + ¼ G, que são os animais de maior efetivo na região. Esse tipo de cruzamento foi essencial para manter o gado produtivo em situações de escassez alimentar e enfrentamento de secas, uma das características inerentes da região. Mesmo com um gado cruzado com bons índices zootécnicos, muitas propriedades não realizam um manejo de administração básica do rebanho como, por exemplo, uma escrituração zootécnica, tampouco um controle leiteiro para descarte de vacas com baixa produção, repetidoras de estro, secas, vazias etc. Essa escassez de informações do rebanho configura a região da bacia leiteira como uma região em que as vacas possuem potencial leiteiro, mas que não são totalmente aproveitadas no que tange seu potencial genético. Desta forma, buscou-se avaliar o manejo nutricional de 15 propriedades leiteiras da região fazendo um balanço do impacto da alimentação do rebanho sobre os índices de produção e reprodução das vacas no sistema de produção e como, através da alimentação, tais índices zootécnicos poderiam ser melhorados através de medidas de manejo básicas na propriedade. -/- REFERÊNCIAS BIBLIOGRÁFICAS AIRES, P. In this paper I argue that the search for explainable models and interpretable decisions in AI must be reformulated in terms of the broader project of offering a pragmatic and naturalistic account of understanding in AI. Intuitively, the purpose of providing an explanation of a model or a decision is to make it understandable to its stakeholders. But without a previous grasp of what it means to say that an agent understands a model or a decision, the explanatory strategies will (...) lack a well-defined goal. Aside from providing a clearer objective for XAI, focusing on understanding also allows us to relax the factivity condition on explanation, which is impossible to fulfill in many machine learning models, and to focus instead on the pragmatic conditions that determine the best fit between a model and the methods and devices deployed to understand it. After an examination of the different types of understanding discussed in the philosophical and psychological literature, I conclude that interpretative or approximation models not only provide the best way to achieve the objectual understanding of a machine learning model, but are also a necessary condition to achieve post hoc interpretability. This conclusion is partly based on the shortcomings of the purely functionalist approach to post hoc interpretability that seems to be predominant in most recent literature. (shrink)

Este artigo constitui uma reflexão acerca desta central e controversa afirmação contida na terceira parte de Verdade e Método segundo a qual "ser que pode ser compreendido é linguagem". Depois de apresentar uma tríplice leitura dessa mesma afirmação, concretamente na sua dimensão platónica, kantiana, e hegeliana, o artigo procura sobretudo desenvolver uma leitura ontológica da mesma. É assim que, partindo dessa tríplice leitura, o presente trabalho intenta justificar e fundamentar a Ontologia hermenêutica de Gadamer, a qual considera ser, para além (...) de diferente, mais autêntica que a Onto-teologia aristotélica e a Ontologia fundamental heideggeriana. Dessa forma, o artigo intenta fazer, a partir da obra de Hans-Georg Gadamer, uma descrição da Hermenêutica filosófica a partir da afirmação segundo a qual "ser que pode ser compreendido é linguagem". /// Aim of the present article is to reflect upon this central and controversial statement, taken from the third part of Truth and Method, according to which "being that can be unterstood is language". After presenting three possible readings of the above mentioned statement, namely the Platonic, the Kantian, and the Hegelian, the article proceeds to develop an onto logical reading of the same passage. Thus, on the basis of these readings, the article both justifies and grounds the gadamerian hermeneutical ontology, which it considers as being different from and more authentic than both the Aristotelian onto-theology and the Heideggerian fundamental ontology. The paper, finally, describes how the notion of philosophical Hermeneutics, as it is found in the work of Hans-Georg Gadamer, is summarized in the affirmation according to which "being that can be unterstood is language". O presente trabalho pretende inserir a História da Psicologia dentro de um debate mais alargado, em torno das Histórias da Filosofia e das Ciências. Para isso, o objeto de análise é a célebre frase de Ebbinghaus, 'A Psicologia tem um longo passado, mas uma curta história', e toda a tradição de livros e textbooks decorrente dela, muito popular nos séculos XX e XXI. O trabalho analisará o texto de Ebbinghaus e seus compromissos decorrentes. Então realizará uma crítica a essa tradição, (...) em três frentes: primeiramente, trazendo à tona estudos mais recentes sobre Gustav Fechner, encarado como figura central na constituição da Psicologia como ciência, mas não obstante ignorado por seus compromissos 'especulativos'; em segundo lugar, confrontando tais questões com as perspectivas do século XX, especialmente a história epistemológica das ciências; finalmente, abrindo o 'longo passado' a uma história mais alargada, a partir de analistas mais contemporâneos que começaram a perscrutar o próprio termo 'Psicologia'. ____________________________________________________________________________________________ This paper intends to insert the History of Psychology in a wider debate along with the History of Philosophy and History of Science. In order to do that, the object of analysis is Hermann Ebbinghaus’s famous phrase, ‘Psychology has an old past, but a short history’, and all the tradition of books and textbooks due to it, very popular on the 20th and 21st centuries. The paper is going to analyse Ebbinghaus’s text and its historical commitments and consequences. Then will perform a critics of this tradition, in 3 fronts of arguments: firstly, bringing up some more recent studies on Gustav Fechner, seen as a central character on the making of Psychology as a science, but nevertheless ignored for its ‘speculative’ commitments. Secondly, the paper will confront such questions with the historical perspectives of 20th century, specially the epistemological history of science. Finally, the paper will open the argument of ‘old past’ to a more wide ‘history’, showing contemporary analysts who started to scan the historical meaning of the word ‘Psychology’. (shrink)

RESUMO: O presente texto põe algumas questões referentes à “história” dos fundamentos da Psicologia entre os séculos XIX e XX, mostrando como ocorrem ainda, em História da Psicologia, certos fatores controversos, muitos deles tributários de postulados filosóficos do século XIX, especialmente em torno do positivismo. O artigo concentra-se em mostrar, preliminarmente, de que forma a ruptura da Filosofia Natural e a ascensão da figura do “cientista” no século XIX ensejaram novos motivos de análise, dentre eles certo cientificismo que se impôs (...) inclusive como chave de interpretação histórica. The article concentrates in showing, in a preliminary way, how the rupture of Natural Philosophy of 18th century and the rise of the figure of the scientist in the 19th century gave rise to new analytical patterns, as well as a certain Scientism that tried to impose itself as the keystone to historical interpretation. The work begins with an initial exposition of the problem – calling into attention the institutional consequences as well, from the psychological common sense to professional issues -, and then analyzes three case studies - Gustav Fechner, Hermann von Helmholtz and Wilhelm Wundt – ending with the defense of perspectives that open the History of Psychology into another historical procedures, such as History of Philosophy and History of Sciences. Detendo-se no pecado enquanto construção histórico-cultural e sociorreligiosa em um processo que encerra os seus aspectos mítico-religiosos, o artigo assinala que o conceito que expressa a sua noção guarda raízes nas fronteiras envolvendo o fracasso humano no sentido de corresponder ao arcabouço paradigmático e o seu sistema de tabus, leis e códigos morais. Dessa forma, convergindo para os aspectos etimológico-literários e bíblico-religiosos do pecado, o artigo sublinha que, encerrando o sentido de errar o alvo, a tradução do referido termo como (...) “pecado” mantém correspondência com a transposição textual instaurada pela versão Septuaginta em um movimento de abstração da noção de culpa moral. Baseado na leitura dos aspectos filosófico-teológicos do pecado em Paul Ricoeur, o artigo sublinha que o pecado não consiste em um termo capaz de esgotar o sentido da realidade que implica como símbolo da ruptura entre essência e existência, convergindo para a sua caracterização como símbolo do mal e “grandeza mítica” através de uma construção que assinala o pecado enquanto intersecção envolvendo o mal e o mundo e atribui a sua emergência ao ato e determina a sua identificação como produto e simultaneamente causa. Assim, detendo-se nos aspectos bíblico-teológicos do pecado em Paul Tillich e na construção do conceito como alienação entre a “não-fé” e o “não-amor”, o artigo enfatiza o caráter irredutível da concepção que, segundo o Apóstolo Paulo, encerra a condição de um poder quase pessoal que controla este mundo, o que implica a sobreposição de um estado de coisas caracterizado pela objetividade e a configuração do acontecimento ora designado como ruptura envolvendo essência e existência em um movimento que possa representar a separação humana do “Ser-em-Si” e expressar o elemento de responsabilidade pessoal imbricado em sua dinâmica existencial. O objetivo central deste estudo é fazer ressaltar as características dos conceitos de animismo, magia e feitiçaria a partir das perspectivas de Sigmund Freud e Bronislaw Malinowski. Em um primeiro momento, analisaremos o animismo. Em seguida, uma vez que as observações etnográficas de Malinowski divergem daquelas de Freud, examinaremos a magia e a feitiçaria com a finalidade de verificar não somente as divergências, mas também as convergências e as aproximações possíveis que existem entres estes dois pensadores e os próprios conceitos (...) entre si. Por fim, mostraremos o que está no centro dessas análises e quais são as razões que fundamentam esses métodos e as resistências que eles podem suscitar. (shrink)

Many word forms in natural language are polysemous, but only some of them allow for co-predication, that is, they allow for simultaneous predications selecting for two different meanings or senses of a nominal in a sentence. In this paper, we try to explain (i) why some groups of senses allow co-predication and others do not, and (ii) how we interpret co-predicative sentences. The paper focuses on those groups of senses that allow co-predication in an especially robust and stable way. We (...) argue, using these cases, but focusing particularly on the multiply polysemous word ‘school’, that the senses involved in co-predication form especially robust activation packages, which allow hearers and readers to access all the different senses in interpretation. Many multinational corporations develop business operations in Europe. The current research attempts to fill the gap on how corporations can increase their political influence in this geography by exploring the joint effect of corporate political activity(CPA) and social responsibility (CSR) on political embeddedness and financial performance. Based on institutional theory and on a sample of autochthonous (European Union [EU]) and allochthonous (non-EU) firms with declared EU lobbying (from 2008to 2019) we conducted two studies. Based on a multi-level model, Study 1 (...) finds strong and robust evidence that boardroom gender diversity and EU lobbyists inter-actively increase EU political embeddedness. Complementarily, Study 2, which relies on general linear Modeling, suggests that allochthonous corporations are more profit-able when they display high-level political embeddedness and lobbying expenditures, combined with adoption of United Nations (UN) guidelines. Overall, findings show that lobbying in Europe pays off, especially when corporations strive to be aligned with EU ethical values and aspirations. Hiring lobbyists to be based in Brussels and promoting gender equality help establish EU political connections. Subsequently, findings highlight the role that EU political embeddedness, lobbying expenditures, and UN guidelines play in leveraging financial performance, especially across non-EU corporations. Regarding EU corporations, results show that a firm-level investment on CPA-CSR is particularly important. Overall, findings from this research support corporations that are growing businesses in Europe. There is a growing awareness that there are many subtle forms of exclusion and partiality that affect the correct workings of a judicial system. The concept of epistemic injustice, introduced by the philosopher Miranda Fricker, is a useful conceptual tool to understand forms of judicial partiality that often go undetected. In this paper, we present Fricker’s original theory and some of the applications of the concept of epistemic injustice in legal processes. In particular, we want to show that the seed (...) planted by Fricker has flourished into a rich field of study in which the concept is used to analyze many different phenomena in law, not always following the original characterization provided by her. This has led to a distinction between what we will call the narrow version of the concept, which is closer to Fricker’s original account, and the wider version of epistemic injustice, which is a more controversial notion because it is always on the verge of morphing into other well-known concepts like sexism, racial discrimination, oppression, silencing, and gaslighting. We will show that the value of the narrow version is mostly theoretical, and that in order to use the concept of epistemic injustice one must adopt a more liberal understanding of it. (shrink)

A relação entre os modos e a substância na filosofia de Espinosa é tida tradicionalmente como de inerência, de maneira semelhante, grosso modo, à relação entre os acidentes e as substâncias na filosofia aristotélica. Essa concepção de inerência foi contestada por Edwin Curley a partir de 1969. Esta monografia, no primeiro capítulo, procura defender que a relação entre os modos e a substância em Espinosa é de inerência, contra Curley, explicando em que consiste essa relação e diferenciando-a da concepção aristotélica (...) de inerência. No segundo capítulo, são apresentadas e respondidas objeções elaboradas por Pierre Bayle ainda no século XVIII contra a concepção de inerência dos modos na substância em Espinosa e que serviram como apoio para os ataques de Curley. Abstract In The Descent of Man (1879), Charles Darwin proposed a speculative evolutionary explanation of extended benevolence—a human sympathetic capacity that extends to all nations, races, and even to all sentient beings. This essay draws on twenty-first century social science to show that Darwin’s explanation is correct in its broad outlines. Extended benevolence is manifested in institutions such as legal human rights and democracy, in behaviors such as social movements for human rights and the protection of nonhuman animals, and in (...) normative attitudes such as emancipative values and a commitment to promote the rights or welfare of animals. These phenomena can be substantially explained by cultural evolutionary forces that trace back to three components of what Darwin called the human “moral sense”: (1) sympathy, (2) our disposition to follow community rules or norms, and (3) our capacity to make normative judgments. Extended benevolence likely emerged with “workarounds,” including political ideologies, that established an inclusive sympathetic concern for sentient life. It likely became as widespread as it is now due to recently arisen socio-economic conditions that have created more opportunities for people to have contact with and take the perspective of a broader cross-section of humanity, as well as other species. Our purpose is to defend the possibility of “perceptualism,” that is to say, the position maintaining that the intelligible content of consciousness is given in perception and not posited by the activity of the subject. Assisted by the insights of Cornelio Fabro, this defense contrasts perceptualism with Bernard Lonergan’s “critical realism”. Current work in language models (LMs) helps us speed up or even skip thinking by accelerating and automating cognitive work. But can LMs help us with critical thinking -- thinking in deeper, more reflective ways which challenge assumptions, clarify ideas, and engineer new concepts? We treat philosophy as a case study in critical thinking, and interview 21 professional philosophers about how they engage in critical thinking and on their experiences with LMs. We find that philosophers do not find LMs to (...) be useful because they lack a sense of selfhood (memory, beliefs, consistency) and initiative (curiosity, proactivity). We propose the selfhood-initiative model for critical thinking tools to characterize this gap. Using the model, we formulate three roles LMs could play as critical thinking tools: the Interlocutor, the Monitor, and the Respondent. We hope that our work inspires LM researchers to further develop LMs as critical thinking tools and philosophers and other 'critical thinkers' to imagine intellectually substantive uses of LMs. (shrink)

Detendo-se no pecado em Pelágio como possibilidade enquanto exercício da liberdade e responsabilidade individual, o artigo assinala a defesa da neutralidade envolvendo a criação do ser humano e a sua capacidade para o bem e o mal, sublinhando a liberdade da vontade e a sua absoluta indeterminação, o que atrela o pecado à escolha. Portanto, atribuindo à vontade a condição de locus da instauração da experiência ético-lógico existencial envolvendo o exercício da liberdade, Pelágio se contrapõe a tese do pecado original (...) enquanto herança psico-biológica, intelecto-afetiva e volitivo-consciencial transmitida pelo arquétipo humano em Adão para a sua descendência. Dessa forma, assinalando a vontade como a causa do pecado em um movimento que converge para encerrar a sua imputação ao agente enquanto detentor da vontade em exercício, o texto mostra que Agostinho afirma, paradoxalmente, a tendência humana para a prática do mal como resultante da herança adâmica, que impõe a sua posteridade a condição de absoluta depravação e inescapável culpa, na medida em que o ser humano é constituído enquanto tal em estado de santa inocência em um processo que atribui ao pecado a condição de um produto da escolha humana através do exercício de sua liberdade e plena consciência. Finalizando, a pesquisa examina o pecado como símbolo racionalentre Pelágio e Agostinho segundo Paul Ricoeur, que afirma a necessidade de um processo que seja capaz de desconstruir o conceito em função da emergência da intenção ortodoxa enquanto sentido reto e eclesial. In a recent paper, Erasmus et al. (2021) defend the idea that the ambiguity of the term “explanation” in explainable AI (XAI) can be solved by adopting any of four different extant accounts of explanation in the philosophy of science: the Deductive Nomological, Inductive Statistical, Causal Mechanical, and New Mechanist models. In this chapter, I show that the authors’ claim that these accounts can be applied to deep neural networks as they would to any natural phenomenon is mistaken. I also (...) provide a more general argument as to why the notion of explainability as it is currently used in the XAI literature bears little resemblance to the traditional concept of scientific explanation. It would be more fruitful to use the label “understandable AI” to avoid the confusion that surrounds the goal and purposes of XAI. In the second half of the chapter, I argue for a pragmatic conception of understanding that is better suited to play the central role attributed to explanation in XAI. Following De Regt (2017) and Kuorikoski and Ylikoski (2015), the conditions of satisfaction for understanding an ML system are fleshed out in terms of an agent’s success in using the system. Cada día es más evidente que existen muchas formas sutiles de exclusión y parcialidad que afectan el correcto funcionamiento de los sistemas jurídicos. El concepto de injusticia epistémica, introducido por la filósofa Miranda Fricker, ofrece una herramienta conceptual útil para comprender estas formas de exclusión y parcialidad judicial que a menudo pasan desapercibidas. En este artículo presentamos la teoría original de Fricker y algunas de las aplicaciones del concepto de injusticia epistémica en los procesos jurídicos. En particular, queremos demostrar que (...) la semilla sembrada por Fricker ha generado un floreciente campo de estudio en el cual el concepto se utiliza para analizar muchos fenómenos diferentes en el ámbito jurídico, no siempre siguiendo la caracterización original proporcionada por ella. Esto ha llevado a una distinción entre lo que llamaremos la versión estrecha del concepto, que se acerca a la descripción original de Fricker, y la versión más amplia de injusticia epistémica, que es una noción más controvertida porque existe el riesgo de que se confunda con otros conceptos más conocidos como el sexismo, la discriminación racial, la opresión, el silenciamiento y el gaslighting. According to Molinism, logically prior to his creative decree, God knows via middle knowledge the truth value of the counterfactuals or conditionals of creaturely freedom (CFs) and thus what any possible person would do in any given circumstance. Critics of Molinism have pointed out that the Molinist God gets lucky that the CFs allow him to actualize either a world of his liking or even a good-enough world at all. In this paper, I advance and strengthen the popular critique in (...) two ways. First, I specify the kind of luck to which God is subject, which is circumstantial moral luck. Second, and more importantly, I argue that exposure to this luck is problematic because something external to God and beyond his control determines the degree of praiseworthiness he deserves in relevant possible worlds. My main contention is that divine subjection to circumstantial moral luck raises the theoretical costs of Molinism. (shrink)

Los sesgos cognitivos afectan negativamente la toma de decisiones en todas las esferas de la vida, incluyendo las decisiones de los jueces. La imposibilidad de eliminarlos por completo de la práctica del derecho, o incluso de controlar sus efectos, contrasta con el anhelo de que las decisiones judiciales sean el resultado exclusivo de un razonamiento lógico-jurídico correcto. Frente el efecto sistemático, recalcitrante y porfiado de los sesgos cognitivos, una posible estrategia para disminuir su efecto es enfocarse, no en modificar el (...) comportamiento de los agentes judiciales, sino en moldear su entorno para que los sesgos tengan menos oportunidades de aparecer. En particular, es más provechoso concentrar los esfuerzos en identificar aquellas reglas procesales que faciliten o limiten el efecto de los sesgos. En este ensayo propongo un diálogo fructífero entre el derecho y la psicología que puede llevar a mejorar la calidad de los sistemas judiciales. La propuesta está basada en la creación de guías de práctica judicial que puedan servir de base para la creación de protocolos procesales que limiten en la medida de lo razonable sus efectos negativos y conduzcan a mejores decisiones judiciales. Unlike other classical arguments for the existence of God, Pascal’s Wager provides a pragmatic rationale for theistic belief. Its most popular version says that it is rationally mandatory to choose a way of life that seeks to cultivate belief in God because this is the option of maximum expected utility. Despite its initial attractiveness, this long-standing argument has been subject to various criticisms by many philosophers. What is less discussed, however, is the rationality of this choice in situations where the (...) decision-makers are confronted with greater uncertainty. In this paper, I examine the imprecise version of Pascal’s Wager: those scenarios where an agent’s credence that God exists is imprecise or vague rather than precise. After introducing some technical background on imprecise probabilities, I apply five different principles for decision-making to two cases of state uncertainty. In the final part of the paper, I argue that it is not rationally permitted to include zero as the lower probability of God’s existence. Although the conditions for what makes an act uniquely optimal vary significantly across those principles, I also show how the option of wagering for God can defeat any mixed strategy under two distinct interpretations of salvation. The use of machine learning algorithms has become ubiquitous in hiring decisions. Recent studies have shown that many of these algorithms generate unlawful discriminatory effects in every step of the process. The training phase of the machine learning models used in these decisions has been identified as the main source of bias. For a long time, discrimination cases have been analyzed under the banner of disparate treatment and disparate impact, but these concepts have been shown to be ineffective in the (...) context of AI. This paper examines the possibility of studying algorithmic discrimination from the perspective of negligence law. Negligent selection and validation of datasets and classifiers is a salient cause of improper training in machine learning. It is a breach of an employer’s duty to protect others, a failure of its exercise of due care in the manner of choosing employees. Adopting negligence to algorithmic discrimination requires a reformulation of what is foreseeable and reasonable within the context of black box algorithms, and a shift in the burden of proof to the employer, who must present evidence of its efforts to avoid bias. Proponents of the duty to vote (DTV) argue that in normal circumstances, citizens have the moral duty to vote in political elections. Discussions about DTV analyze _what_ the duty is, _who_ has this duty, _when_ they have it, and _why_ they have it. Missing are answers to the Specification Question: to _which_ elections does DTV apply? A dilemma arises for some supporters of DTV—in this paper, I focus on Julia Maskivker’s work—because either answer is problematic. First, I argue that it (...) is implausible that DTV applies to _all_ elections because this makes the duty too costly for the voter. Second, I argue that there are no good reasons why under normal circumstances DTV applies only to _some_ elections. I consider objections but conclude that the dilemma is successful and therefore the case for DTV is incomplete. (shrink)

This paper deals with the mutations in Wittgenstein’s treatment of the notions of “generality” and of “singularity”, from his first philosophy, in the Tractatus Logico-Philosophicus, to his later mature philosophy represented by the Philosophical Investigations. As we shall see, Wittgenstein’s philosophical handling of the notion of “visual perception” plays a key role in those conceptual transformations.

Durante los últimos años, el problema de cómo justificar aquellas creencias que se originan en testimonios ha ocupado un lugar central en la epistemología. Sin embargo, muy pocas de esas reflexiones son conocidas en el derecho probatorio. En el presente ensayo analizo la prueba testimonial a la luz de estas reflexiones con el fin de poner de manifiesto los supuestos epistemológicos de algunos principios procesales. En concreto, analizo la legislación colombiana y la estadounidense en el marco de la disputa entre (...) el reduccionismo y el antirreduccionismo en la filosofía del testimonio. Al final sugiero una nueva aproximación epistemológica que replantea los términos de la disputa y que tiene implicaciones importantes para la valoración de la prueba testimonial en los procesos judiciales. In this paper I defend the idea that there is a sense in which it is meaningful and useful to talk about objective understanding, and that to characterize that notion it is necessary to formulate an account of explanation that makes reference to the beliefs and epistemic goals of the participants in a cognitive enterprise. Using the framework for belief revision developed by Isaac Levi, I analyze the conditions that information must fulfill to be both potentially explanatory and epistemically valuable (...) to an inquiring agent and to a scientific community. To be potentially explanatory, the information must state the relations of probabilistic relevance that the explanans bares to the explanandum. But a potential explanation con only be a bona fide explanation if it becomes part of inquiry, that is, if an agent or a group of agents can see any value in it for their cognitive purposes. I provide a way to evaluate the epistemic value of a potential explanation as a function of its credibility and its informational content. (shrink)

El testimonio es nuestra mayor fuente de creencias. La gran mayoría de nuestras creencias han sido adquiridas a partir de las palabras de otros y no a través de la observación directa del mundo. Una de las peculiaridades de la mayor parte de las creencias testimoniales es que son aceptadas sin ninguna deliberación consciente. Mientras el testimonio sea consistente con nuestras creencias y la fuente sea confiable, la reacción más corriente es la aceptación automática de la información (Thagard 2004, 2005). (...) Nuestra confianza en el testimonio de los demás es un requisito no sólo para la construcción colectiva del conocimiento (Hardwig 1985, 1991), sino también para la interacción social en general. Sin embargo existen contextos en los que la aceptación apresurada de un testimonio falso puede tener consecuencias nefastas. En contextos científicos, legales, políticos y financieros, entre otros, se toman decisiones importantes y se implementan políticas cruciales a partir de las afirmaciones de otros. En estos contextos la aceptación de un testimonio debe ser el resultado de un proceso de decisión basado en criterios objetivos de justificación. Sin embargo, existen dos objeciones al intento de justificar la aceptación de un testimonio (Coady 1973, 1992). La primera es que cualquier justificación será irremediablemente circular puesto que la inmensa mayoría de testimonios obtienen su justificación, al menos en parte, de evidencia de tipo testimonial. La segunda es que nuestras inferencias acerca de la confiabilidad de ciertos tipos de testimonio nunca tendrán un apoyo inductivo lo suficientemente fuerte debido a que los casos en los que un tipo de testimonio puede ser verificado directamente en la experiencia nunca serán lo suficientemente numerosos. En este ensayo presento una solución al problema de cómo decidir racionalmente si un testimonio puede ser aceptado como evidencia probatoria en una investigación. Mi propuesta, que está basada en la teoría de revisión de creencias desarrollada por Levi (1984, 1991), muestra que la aceptación justificada de un testimonio está basada en exactamente los mismos mecanismos de adquisición de creencias que operan en el caso de evidencias no testimoniales; al mismo tiempo, la propuesta da cuenta de las particularidades que se presentan en el proceso de evaluación de una evidencia testimonial. Mi tesis es que la decisión de aceptar un testimonio es un proceso que se cumple en dos etapas. En la primera se busca una justificación pare el testimonio buscando todos los hechos que aumenten la probabilidad de que el testimonio sea verdadero, es decir, de que el testigo o declarante esté reportando verídicamente un hecho. La aceptación de estos hechos y de su relación probabilística positiva con respecto al testimonio está basada en la búsqueda de un equilibrio entre su credibilidad y su valor informativo. En la segunda etapa, se determina si la justificación obtenida en la primera es suficiente para la aceptación del testimonio, de nuevo buscando encontrar un equilibrio entre su credibilidad y la utilidad de la información que contiene en promover los intereses y metas cognitivas del investigador. The objective of this article is to try to elucidate Wittgenstein’s ex-travagant thesis that each and every mathematical advancement involves some “semantical mutation”, i.e., some alteration of the very meanings of the terms involved. To do that we will argue in favor of the idea of a “modal incompati-bility” between the concepts involved, as they were prior to the advancement, and what they become after the new result was obtained. We will also argue that the adoption of this thesis profoundly (...) alters the traditional way of con-struing the idea of “progress” in mathematics. (shrink)

Resumen: Una de las formas más comunes y menos estudiadas de parcialidad judicial subjetiva es la disminución de la credibilidad otorgada a un testigo debido a un prejuicio identitario implícito del agente judicial. En la epistemología social, este fenómeno ha sido estudiado bajo la rúbrica de la injusticia testimonial. En este ensayo mostramos que para determinar la ocurrencia de un caso de injusticia testimonial en el derecho se deben cumplir tres condiciones que son imposibles de verificar empíricamente y que están (...) basadas en presupuestos psicológicos que han sido puestos en duda en años recientes. Sin la posibilidad de verificar estas condiciones, estamos frente a un tipo de parcialidad judicial indetectable. En su lugar, ofrecemos una nueva forma de entender la injusticia testimonial en el derecho como un fenómeno más general que describe una tendencia comportamental prejuiciosa recurrente por parte de un agente judicial. Entendida de este modo, la injusticia testimonial es completamente verificable. -/- Abstract: One of the most common and least studied forms of subjective judicial partiality is the credibility deficit suffered by a witness due to an implicit identity prejudice in a judicial agent. Social epistemologists have studied this form of partiality under the rubric, “testimonial injustice.” In this essay we argue that to verify the occurrence of a singular instance of testimonial injustice in law three facts must be established, none of which can be established with any degree of confidence. Furthermore, all of them are based on psychological suppositions that have been recently discredited. Without the possibility of establishing these facts, we end up with an undetectable form of subjective judicial partiality. In its place, we offer a new way of understanding testimonial injustice in law as a general phenomenon that describes a recurrent pattern of prejudiced behavior in a judicial agent. Under this characterization, testimonial injustice becomes empirically verifiable. (shrink)

Here the point of departure of Being and Time is criticized, i.e. the priority of Dasein in the determination of the meaning of being. An overview of Heidegger’s doctrine is offered, his concern for intentionality is acknowledged, then it takes place a critique of his starting point, and finally a Thomistic alternative account of intentionality is proposed.

Many theists conceive of God as a perfect being, i.e., as that than which none greater is metaphysically possible. On this grand view of God, it seems plausible to think that such a supreme and maximally great being would not be subject to luck of any sort. Given the divine perfections, God is completely insulated from luck. However, I argue that the opposite is true: precisely because God is perfect, he is subject to a kind of luck called constitutive luck. (...) In this paper, first I provide an analysis of luck and then explain the concept of constitutive luck. I proceed to defend constitutive luck from charges of incoherence and examine a different approach to make sense of this luck. Furthermore, I distinguish between two kinds of constitutive luck and argue that even if God isn’t subject to one kind, evading the second kind is unsuccessful. I offer two ways that God is constitutively lucky and reach a surprising conclusion: a perfect being is the luckiest of all possible beings. (shrink)

The boundary problem is related to the binding problem, part of a family of puzzles and phenomenal experiences that theories of consciousness (ToC) must either explain or eliminate. By comparison with the phenomenal binding problem, the boundary problem has received very little scholarly attention since first framed in detail by Rosengard in 1998, despite discussion by Chalmers in his widely cited 2016 work on the combination problem. However, any ToC that addresses the binding problem must also address the boundary problem. (...) The binding problem asks how a unified first person perspective (1PP) can bind experiences across multiple physically distinct activities, whether billions of individual neurons firing or some other underlying phenomenon. To a first approximation, the boundary problem asks why we experience hard boundaries around those unified 1PPs and why the boundaries operate at their apparent spatiotemporal scale. We review recent discussion of the boundary problem, identifying several promising avenues but none that yet address all aspects of the problem. We set out five specific boundary problems to aid precision in future efforts. We also examine electromagnetic (EM) field theories in detail, given their previous success with the binding problem, and introduce a feature with the necessary characteristics to address the boundary problem at a conceptual level. Topological segmentation can, in principle, create exactly the hard boundaries desired, enclosing holistic, frame-invariant units capable of effecting downward causality. The conclusion outlines a programme for testing this concept, describing how it might also differentiate between competing EM ToCs. (shrink)

But it can be freed of this association, to become the distinction between statements made within make-believe games and those made outside them-or, rather, a special case of it with some claim to be called the metaphorical/literal distinction. Not even Quine considers figurative speech committal, so this turns the tables somewhat. To determine our ontological commitments, we have to ferret out all traces of (...) nonliterality in our assertions; if there is no sensible project of doing that, there is no sensible project of Quinean ontology. /// [Andre Gallois] I discuss Steve Yablo's defence of Carnap's distinction between internal and external questions. In the first section I set out what I take that distinction, as Carnap draws it, to be, and spell out a central motivation Carnap has for invoking it. In the second section I endorse, and augment, Yablo's response to Quine's arguments against Carnap. In the third section I say why Carnap's application of the distinction between internal and external questions runs into trouble. In the fourth section I spell out what I take to be Yablo's version of Carnap. In the last I say why that version is especially vulnerable to the objection raised in the second. (shrink)

Some Molinists claim that a perfectly good God would actualize a world that is salvifically optimal, that is, a world in which the balance between the saved and damned is optimal and cannot be improved upon without undesirable consequences. I argue that given some plausible principles of rationality, alongside the assumptions Molinists already accept, God’s perfect rationality necessarily would lead him to actualize a salvifically optimal world; I call this position “Optimistic Molinism.” I then consider objections and offer replies, concluding (...) that Optimistic Molinism is undefeated and merits further exploration.
